2. “There is nothing more fundamental than rule of law.” Prepare a balance sheet of achievements and failures of rule of law over the past 60 years since independence and discuss the role of judiciary in this regard.
3. “The Indian federal structure has adopted merits and avoided demerits faced by other federal constitutions and it has also brought in some novel provisions which are not to be found in other federations.” Comment. (12)
4. Comparatively discuss the patterns of federal Governments which prevails in U.S.A, Australia, Canada and India. What pattern you like most- Give reasons. (12)
5. How equality can be established among unequals- What test have been propounded by the judiciary to establish equality in India- Discuss with the help of decided cases. (12)
6. Do you agree that Supreme Court has opened a ‘Pandora box’ of many such rights beginning from ‘Maneka Gandhi’ case and has aroused expectations and aspirations, which the stats is intact not in a position to meet. Will you advocate for a check on such evolution- Examine critically. (12)
7. Contrary to the wishes of the founding fathers of the constitution, the judiciary has usurupled the powers and functions of the Executive and the Parliament/State Legislatures. How can judiciary be made accountable in the crux of the problem. Point out the methods of making the judiciary accountable to the democratic norms. (12)
