UNIT – I
Q. No. 1. (a) Define offer. Explain the rules relating to valid offer. Marks : 15
OR
“An agreement without consideration is void”. Discuss.
(b) Solve the following problem : Marks : 5
“A” out of natural love and affection promises to give his son “B” Rs. 1,000 under a registered document. Is it a valid contract ?
OR
“A” agrees to sell his Luna to his friend for Rs. 4,000/- or Rs. 5,000/-. His friend agrees to purchase. Is this agreement contract ?

UNIT – II :
Q. No. 2. (a) “Certain persons are incompetent to contract”. Discuss. Marks : 15
OR
Discuss the doctrine of public policy.
(b) Solve the following problem : Marks : 5
“A” a minor has lent Rs. 1,000/- against the promissory note executed in his favour. Is borrower liable ?
OR
“A” while his wife “B” is alive promised to marry “C” in the event of B’s death. Subsequently “B” died. But “A” refuses to marry, “C”. Advise “C”.

UNIT – III :
Q. No. 3. (a) Explain the doctrine of frustration with reference to decided cases. Marks : 15
OR
Define breach of contract. Discuss kinds of breach of contract.
(b) Solve the following problem : Marks : 5
A musical hall was agreed to be let out on certain day. But before that, it was destroyed by fire. Is the promisor absolved from the contract.
OR
A, B and ‘C’ jointly promise to pay Rs. 30,000 to “D”. “B” becomes insolvent. Discuss the liability of A, B and “C”. A, B

UNIT – IV :
Q. No. 4. (a) “Damages are compensatory and not penal”. Elucidate. Marks : 15
OR
Explain the principle of “Remoteness of damages”, with special reference to Hadley Vs. Baxendale case.
(b) “x” a dealer in fruits leaves a packet containing fruits at “y”’s house by mistake. “y” consumes those fruits. Can “x” recover money ? Marks : 5
OR
A mate was engaged for lumpsum to be paid after the completion of voyage. The mate dies when only 2/3rd of voyage was complete. His legal representatives claim damages on quantum merit basis. Decide.

UNIT – V :
Q. No. 5. (a) “Specific relief is a judicial discretionary remedy”. Comment. Marks : 15
OR
Who may obtain specific performance of contract under the Specific Relief Act ?

1. Answer Q. No. 9 and any five of the remaining questions.
2. Q. No. 9 carries 20 marks and the remaining carry 16 marks each.
3. Answers should be written either in English or Kannada completely.

Q. No. 1. Define offer and acceptance and explain the rules regarding their revocation. Marks : (4×16=64)
Q. No. 2. “An agreement without consideration is void”. Comment and state exceptions.
Q. No. 3. Who are competent to contract ? Discuss the effects of minor’s agreement.

Q. No. 4. What is coercion ? Explain its effect on consent to contract with the help of decided cases.
Q. No. 5. What are agreements are said to be void ? Explain with illustrations.
Q. No. 6. Explain the grounds of impossibility of performance of contract.
Q. No. 7. Explain the provisions relating to recovery of movable and immovable property.

Q. No. 8. Write short notes on any two of the following : Marks : (2×8=16)
a) General offer
b) Reciprocal promises
c) Injunction.

Q. No. 9. Solve any two of the following : Marks  (2×10=20)
a) Prakash has agreed to sell his bike to Kiran for Rs. 20,000. However the bike is destroyed by fire before it is delivered to Kiran. Now Kiran has filed suit for breach of contract against Prakash. Decide.

b) A, a minor transdulently represents to a money lender that he is a major and executed a mortgage deed for Rs. 10,000. Can the money lender recover the money and damages for transdulent misrepresentation ?
